1. Acceptance of Terms

By accessing or using CbamTrack ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Nature of Service

CbamTrack is a compliance assistance tool that helps businesses estimate CBAM-related costs and generate quarterly emission reports for goods imported into the European Union.

The Platform is a calculation aid only. It does not file declarations, submit reports, or communicate with competent authorities on your behalf. The user bears sole responsibility for all CBAM declaration obligations, including timely submission of accurate reports to the relevant national authority.

3. No Legal or Tax Advice

CbamTrack does not provide legal, tax, or regulatory advice. All calculations, reports, and outputs generated by the Platform are estimates based on default values and user-provided data. They do not constitute a definitive determination of your CBAM obligations.

You are strongly advised to verify all outputs with a certified CBAM verifier and/or customs advisor before submission to competent authorities.

4. User Responsibilities

You are solely responsible for:

• The accuracy, completeness, and legality of all data you input into the Platform
• Determining your CBAM obligations and ensuring timely compliance
• Verifying calculation results before any regulatory submission
• Maintaining appropriate records as required by applicable regulations

5. Estimated Results & Regulatory Changes

All results provided by the Platform are estimated in nature. Benchmarks, phase-out rates, ETS prices, and other parameters are based on published EU regulations and may change. CbamTrack does not guarantee that calculations reflect the most current regulatory requirements at the time of your submission.

CBAMTrack is not liable for errors arising from changes in applicable laws, regulations, or interpretations thereof that occur after the date of report generation.

6. Limitation of Liability

To the maximum extent permitted by applicable law, CbamTrack and its operators are provided "as is" without warranty of any kind, express or implied. In no event shall CbamTrack be liable for any damages, including but not limited to:

• Regulatory penalties, fines, or sanctions resulting from inaccurate reports or missed deadlines
• Miscalculations arising from incorrect or incomplete user-provided data
• Business interruption, loss of data, or loss of profits
• Reliance on platform outputs for compliance decisions

7. Data & Privacy

Your use of the Platform is subject to our Privacy Policy. We process personal and company data in accordance with the General Data Protection Regulation (GDPR). By using the Platform, you consent to the collection and processing of data as described in the Privacy Policy.

8. Subscriptions & Billing

Paid plans are billed monthly or annually as selected at sign-up. You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

9. Termination

We reserve the right to suspend or terminate access to the Platform for violations of these Terms or for any other reason at our discretion, with or without notice.

10. Governing Law

These Terms shall be governed by the laws of the Republic of Turkey. Any disputes arising from these Terms shall be resolved in the courts of Istanbul, Turkey.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Users will be notified of material changes via email or through the Platform. Continued use after changes constitutes acceptance of the updated Terms.
